General Info to acquire a property in Thailand as a foreigner
Basically, the applicable law in Thailand does not allow a foreigner to buy land or own it. On the other hand, a foreigner may buy real estate. The purchase of land can only be done from Thai to Thai. A solution would be probably the most commonly practiced combination of buying the building and leasing of the land.
The important certificate of Chanot, and a 30-year lease agreement (from 2013) are available and already included in the sale price. (In the normal case, only the first 30 years lease will be paid by the current owner. For the extension of the term from two times 30 years to a total of 90 years, the new lease amounts will be due after the time has expired. All of this has already been paid in our contract.)
The purchase price is usually to be paid in Thai Baht; the offer price is therefore subject to price fluctuations. All incidental costs (lawyer, taxes, land register entries, etc.) are shared by buyers and sellers at 50% each and are around € 3,000 per party.
Foreign nationals can own the building (villa) in their own name but not the land that it stands on.
Foreign nationals cannot own land in Thailand. The options in which a foreigner can control the land are via a 30-year lease or by purchasing the land through a Thai company.
